According to REF-8 more than 75% of products sold online are non-compliant

During the last ECHA Enforcement Forum project, about 6000 products were evaluated: most of them proved to be non-compliant.

ECHA, with its Enforcement Forum "REF-8" project, in 2020 carried out an inspection in 29 countries, analysing approx. 6000 products.  Many of them did not comply with the standards required.

Regarding REACH Regulation, the main problems are about products non-compliant with Annex XVII restriction, in particular:

  • selling to the public carcinogenic, mutagenic or reprotoxic substances or mixtures, infringing restrictions Nos 28, 29 and 30 of REACH Annex XVII;
  • presence of phthalates above the allowed quantity by restrictions Nos. 51 and 52 in toys;
  • presence of cadmium in jewellery articles above the thresholds permitted by restriction No. 23.

 

As regards CLP Regulation, 75% of chemicals sold online had not hazard information or these were not visible.

As for Biocides Regulation, 77% of the products were non-compliant with at least one of the requirements of the regulation, as those sold to the consumer. Most of them, were non-compliant because of indications as “low-risk product”, “non-toxic” “natural”, “environmentally friendly”, etc.

After these inspections, the Authorities started more than 5,000 procedures, requiring companies to remove their products from their websites and/or give compliant advertisements to the consumers, adding the right hazard information.

Please note that ECHA’s "Forum Enforcement Project", works and coordinates several projects for the implementation of European regulations. Among these, the REFs (REACH EN- FORCE) which aim to harmonise the application measures in each Member State and monitor compliance with REACH and CLP requirements.

Since the indications of the projects, National Authorities carry out their inspection and then transmit all the information to the Forum's working group which draws up the final report.

REF 10 is currently being developed to carry out inspections of articles and mixtures’ compliance, also under POPs Regulation in 2022. Our advice is to keep monitored the compliance of your products.
